JUSTICE SATYAVRAT VERMA ORAL ORDER 18-01-2022 Heard learned counsel for the petitioner and learned A.P.P. for the State through virtual court proceedings. Let the defect(s), if any, be removed within a period of four weeks after complete start of the physical Court. The petitioner seeks regular bail in connection with Valmikinagar P.S. Case No. 14 of 2021 instituted for the offences under Sections 341, 323, 504 and 307/34 of the Indian Penal Code. Learned counsel for the petitioner submits that the petitioner is in custody since 08.02.2021, is a person with clean antecedent and charge-sheet has been submitted in this case. The informant alleges that he was assaulted by iron rod on his head by Ram Chandra Uraon and fell unconsciousness and when he regained consciousness, he was informed by his mother that this petitioner assaulted him with lathi on his head along with Rajan Uraon and when his father came to save him he was also assaulted by

Patna High Court CR. MISC. No.47744 of 2021(2) dt.18-01-2022 2/2 accused persons and Ram Chandra Uraon assaulted the father of the informant by lathi and injured the right hand of his father. Learned counsel for the petitioner submits that as far as allegation of assault is concerned that is alleged specifically against Ram Chandra Uraon of causing head injury to the informant on his head by iron rod whereas the allegation against this petitioner is general and omnibus in nature. He further submits that the informant has not seen the petitioner causing injury on his head. Learned A.P.P. for the State vehemently opposes the prayer for regular bail of the petitioner.

Considering the fact that the petitioner is in custody, is a person with clean antecedent and charge-sheet has been submitted in this case, let the petitioner above named be released on bail on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned 1st Additional Chief Judicial Magistrate, Bagaha, West Champaran in connection with Valmikinagar P.S.
