JUSTICE KISHORE KUMAR MANDAL ORAL ORDER 05-04-2016 Heard the counsel for the petitioner and the State. The petitioner is an accused of Salimpur P.S. Case No. 50 of 2015 registered under section 307 and other penal sections of IPC. The petitioner is alleged to have assaulted with Kudal(spade) on the head of the informant which caused injury. Learned Sessions Judge has noticed the injury caused to the informant.
It is submitted that both parties are neighbours and there is a dispute between both the families over flowing of drain in between the house.
The allegation attributed to the petitioner and the corresponding injury persuades this Court not to extend the privilege of anticipatory bail. Prayer is accordingly refused. The
Patna High Court Cr.Misc. No.12730 of 2016 (2) dt.05-04-2016 2/2 petitioner should surrender and seek regular bail. If he does so, the same shall be considered on its own merit in accordance with law.
