Petitioner apprehends arrest in a case registered for the offences punishable under Section 307 and other allied sections of the Indian Penal Code.

It is alleged that a mob of 500 to 700 persons assembled and indulged in arson in protest of an accident in which two persons were dashed by a speeding truck. It is the contention of the petitioner that the petitioner was member of the mob and there is no specific allegation against him and similarly situated co-accused persons mentioned in paragraph 16 of the bail application have already been allowed bail by different benches of this Court.

No.34628 of 2019(2) dt.28-05-2019 2/2 Considering the facts of the case, let the petitioner, above named, in the event of arrest/surrender before the Court below within a period of six weeks from the date of receipt of the order, be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Begusarai in Barauni (Refinery) Police Station Case No. 336 of 2015, subject to the conditions laid down under Section 438(2) of the Code of Criminal Procedure as well as condition that the petitioner shall fully co-operate with the investigation and trial of the case, failing which the Court below shall be at liberty to cancel the bail bond of the petitioner.
