JUSTICE PRABHAT KUMAR JHA ORAL ORDER 19-02-2015 Learned counsel for the petitioners seeks permission to withdraw the Anticipatory Bail Petition of the petitioner no. 3 Dhanjee Yadav as he has already been arrested. Permission is granted.

Accordingly, the Anticipatory Bail Petition of the petitioner no. 3 is dismissed as having become infructuous. Heard both sides.

The petitioners no. 1, 2 and 4, namely, Ramjee Yadav, Raj Girihi Yadav @ Raj Grihi Yadav and Bimla Devi apprehend their arrest in a case registered under Section 307 and other sections of the Indian Penal Code and Section 3(I)(X)(XII) of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act.

Patna High Court Cr.Misc. No.6767 of 2015 (2) dt.19-02-2015 2/2 Tara Muni Devi, the informant, made allegation that her she-buffalo broke the handle of a tube-well. On such, some verbal altercations took place. The petitioner and other accused persons having armed with different weapons came. Tetar Yadav is alleged to have assaulted Lal Mohar Mushhar and Nandjee Yadav is alleged to have assaulted the mother of the informant. There is no specific allegation against the petitioners. It appears that the occurrence took place on some petty dispute and no specific allegation is made against the petitioners.

Considering the facts aforesaid, the above named petitioners no. 1, 2 and 4, in the event of their arrest or surrender before the learned court below within a period of four weeks from the date of receipt / production of a copy of this order, are directed to be enlarged on bail on furnishing bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate, Ara in Piro (Hasan Bazar) P.S. Case No. 234/2014, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
