1. In this instant petition petitioner has prayed for following relief:- "1. That the present Civil Writ application is being filed for release of vehicle/Bolero ZLX Mahindra Registration No. BR01PG5067 Chesis No. MA1XX2GPKG5E64820, Engine No. GPG4D63015, belong to the petitioner which has been seized by Bheja P.S. Case No.
41/2023, dated 10.05.2023 for alleged offences registered Under
Patna High Court CWJC No.9210 of 2023(2) dt.20-07-2023 2/2 Section 272, 273/34 of the I.P.C 30(a)/47 Bihar Prohibition and Excise Act 2018 the aforesaid case pending in the Court of Ld. A.D.J.-IICum-Special Judge, Excise ActMadhubani, confiscation proceeding has not been initiated against the said seized bolero.
2. Ld. Counsels for the respective parties on instruction submitted that the present petition does not survive for consideration in view of the fact that subject matter of vehicle is released in favour of the petitioner.
3. The present petition stands disposed as it has become infructuous.
