Petitioner apprehends arrest in a case registered for the offence punishable under Sections 323, 354, 427, 498(A), 504 of the Indian Penal Code.
Prosecution case, in brief, is that the husband of the informant died eight years ago and she runs a shop for her livelihood. After the death of her husband, this petitioner along with other accused persons started torturing and assaulting the informant. It is further alleged that this petitioner entered into the house of the informant in a drunken condition and tried to outrage her modesty.

No.37886 of 2023(2) dt.07-07-2023 2/2 It is submitted on behalf of the petitioner that he is the brother-in-law of the informant and due to petty dispute over property, this false and concocted case has been lodged against the petitioner. Petitioner claims clean antecedent. Learned counsel for the State opposes the bail petition of the petitioner.
Considering the aforesaid facts and circumstances of the case, in the event of arrest or surrender within six weeks from today, let the petitioner, as named above, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Gaya in connection with Atri P.S. Case No. 33 of 2023, arising out of Complaint Case No. 1927 of 2022, subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure.
