NILU AGRAWAL ORAL ORDER 16-11-2016 Heard the learned counsel for the petitioners and learned A.P.P. for the State.
Petitioners seek restoration of Criminal Miscellaneous No. 14210 of 2013, which was dismissed on 23.07.2015 for non-compliance of the order dated 09.07.2015 on which date notices were issued to opposite party No. 2 for which the petitioners were directed to file requisites within a period of two weeks.
It has been submitted by the learned counsel for the petitioners that due to laches of his Clerk the said requisites could not be filed within two weeks.
Considering the statement made by the petitioners Criminal Miscellaneous No. 14210 of 2013 is restored to its original file.
Let the petitioners file requisites for issuance of
Patna High Court Cr.Misc. No.49149 of 2016 (2) dt.16-11-2016 2/2 notice both by registered cover with A/D and ordinary process to opposite party No. 2 within two weeks, failing which this application as against opposite party no. 2 shall stand rejected without further reference to the Bench.
