The petitioner seeks bail in anticipation of his arrest in connection with Jogbani (Bathnaha) P. S. Case No. 103 of 2019, dated 03.04.2019, instituted for the offences under Sections 379 and 411 of the Indian Penal Code.
Patna High Court CR. MISC. No.35419 of 2020(2) dt.25-03-2021 2/3 The trolley of the tractor of the informant is said to have stolen away. One Samtullah was made accused in this case. The name of the petitioner has not been mentioned in the F.I.R. but because he had a talk with aforesaid Samtullah on mobile telephone, therefore, he too has been made accused in this case on suspicion. The aforesaid Samtullah has been granted anticipatory bail by a Bench of this Court vide order dated 26.12.2019, passed in Cr. Misc. No. 75343 of 2019.
Considering the afore-stated facts and taking into account that the petitioner is a handicapped person with 50 per cent disability, he is directed to be released on bail, in the event of his arrest or surrender before the court below within a period of eight weeks from the date of receipt / production of a copy of this order, on his furnishing bail bonds in the sum of Rs. 10,000 /- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial
