The petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 341, 342, 365, 329, 467, 468, 471, 406, 420, 120(B), 506 of the Indian Penal Code.

It is a case of forcefully execution of sale deed by the petitioners in favour of petitioners and co-accused persons from the informant.

It is submitted by learned counsel for the petitioners that petitioners are innocent and they have falsely been

Patna High Court CR. MISC. No.37926 of 2022(2) dt.30-11-2022 2/2 implicated in the present case. It is also submitted that F.I.R was lodged after an inordinate delay of 12 days. It is further submitted that petitioner No. 2 is the purchaser of land and as per FIR itself clearly shows that informant has signed the sale deed before the registrar. It clearly shows that petitioners did not cheat anyone. It is submitted that this case is purely civil in nature. A statement has been made in para 3 of the petition that petitioners have no criminal antecedent.

In the facts and circumstance of the case, let the petitioners, above named, in the event of their arrest or surrender before the Court below within a period of four weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/-(Ten Thousands) each with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate 1st Class, Muzaffarpur in connection with Katra P.S. Case No. 58 of 2022, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
