Learned counsel for the petitioner seeks permission to withdraw this application and submitted that during pendency of this application the petitioner has already been released on bail under the provisions of section 167 (2) Cr.P.C., as such this application has become infructuous.

Permission is granted.

Accordingly, this application, filed for grant of bail in connection with Ahiyapur P.S. Case No. 328 of 2020 pending in the Court of learned Special Judge, Excise, Muzaffapur is dismissed as infructuous.
