Petitioners apprehend their arrest in connection with Azam Nagar P. S. case no. 302/2014 registered under sections 354, 307 and other allied sections of the IPC.
The allegation against these petitioners is that they attempted to outrage the modesty of informant's daughter and according to the prosecution case itself, alleged occurrence took place on 19.10.2014 whereas informant gave written report to Superintendent of Police, Katihar on 13.11.2014. Furthermore, it would appear from perusal of the impugned order of the learned Sessions Judge that co-accused Dulal Mahaldar against whom there is allegation of pressing neck of the informant has already been admitted
Patna High Court Cr.Misc. No.9351 of 2015 (2) dt.09-03-2015 to anticipatory bail by learned Sessions Judge itself. Considering the aforesaid facts and circumstances as well as submissions of the parties, this anticipatory bail petition is allowed and it is ordered that in the event of arrest/ surrender within four weeks from the date of receipt of this order to the concerned court, let the above named petitioners be released on bail on furnishing bail bonds of Rs 10,000/- each with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Katihar in Azam Nagar P. S. case no. 302/2014 subject to condition as laid down under section 438(2) of the Cr.P.C.
