In this case, the petitioner is seeking anticipatory bail in connection with Musrigharari P.S. Case No. 14 of 1995 registered for offence punishable under section 364 of the Indian Penal Code. The petitioner has already criminal history of section 302/34 of the Indian Penal Code and the present application has been filed after long delay.

In such view of the matter, this Court is not inclined to grant bail to the petitioner and accordingly his prayer for bail is rejected. However, if the petitioner surrenders and prays for regular bail, the court below will decide the case on its own merit. (Shivaji Pandey, J) Mahesh/- U T
