The petitioner has preferred this application for grant of regular bail in a case registered under section 307 and other sections of the Indian Penal Code and section 27 of the Arms Act.
As per the prosecution case, on the orders of Anil Paswan it is stated that Anil Paswan himself, Alok Kumar (petitioner) as also others started to assault the informant. Further accused Awinash Paswan fired on the informant with a pistol, however the shot missed the informant and it hit one Aakash Paswan.
It is submitted by learned counsel for the petitioner that the petitioner has been falsely implicated in the case. No material injury has been sustained by the informant. The
Patna High Court CR. MISC. No.47710 of 2021(4) dt.09-02-2022 2/2 allegation of firing is not on the petitioner. The petitioner is in custody since 28.6.2021 and has no criminal antecedent. Heard learned APP for the State.
Having heard learned counsel for the parties and taking into consideration the facts and circumstances of the case, the nature of allegation against the petitioner and the petitioner having remained in custody for more than 7 months, the petitioner is directed to be enlarged on bail in connection with Asthawan P.S. Case no. 68 of 2020 on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate, Nalanda at Bihar Sharif.
