JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 24-09-2018 Heard Mr. Vinay Kumar Singh, learned counsel for the petitioner, learned counsel appearing on behalf of the Bihar School Examination Board and learned counsel for the State. Learned counsel appearing on behalf of the Bihar School Examination Board has filed counter affidavit. In view of the subsequent development of publication of result, the grievance of the petitioner for a direction for issuance of marks sheet has become infructuous. The other grievance of the petitioner with regard to a direction to the respondents to appoint the petitioner is concerned, no positive direction can be issued in view of the fact that passing of TET only confers eligibility in the selection

Patna High Court CWJC No.14681 of 2014(2) dt.24-09-2018 2/2 process does not confer any right to appointment. On passing TET the petitioner has acquired eligibility and petitioner may be considered as and when selection process are undertaken by the respondents.

The Court hope and trust that the respondents may undertake selection process to tackle the need of studentsteachers ratio in terms of Right to Compulsory Education Act, 2009.

With the aforesaid, the writ petition stands disposed of.
