The petitioner seeks bail in Fatuha P.S. Case No. 42 of 2019, instituted for the offence under Section(s) 399, 402 of the Indian Penal Code, Sections 25(1-b)a, 26 and 35 of Arms Act.

It is alleged in the written report that one country made pistol and one live cartridge have been recovered from possession of the petitioner.

Counsel for the petitioner submits that co-accused Tarun Kumar has already been granted bail by coordinate Bench of this Court vide order dated 25.6.2019 passed in Cr. Misc. 36828 of 2019.

Patna High Court CR. MISC. No.40770 of 2019(3) dt.30-07-2019 2/2 Petitioner is in custody since 24.1.2019 having clean antecedent.

Considering the aforesaid facts and circumstances of the case, prayer of the petitioner for grant of bail is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-V, Patna City, in connection with Fatuha P.S.
