The instant appeal has been filed by the appellant against the order dated 19.3.2021 passed by the learned 1st Additional Sessions Judge-cum-Special Judge, SC and ST, Bettiah, West Champaran whereby the prayer for bail of the appellant in connection with a case registered under section 302 and other sections of the Indian Penal Code and section 3 of the SC and ST Act was rejected.

As per allegations in the FIR, the 12 named accused persons including the appellant herein are stated to have assaulted the husband of the informant. It is further stated that

Patna High Court CR. APP (SJ) No.3428 of 2021(2) dt.07-09-2021 2/3 accused Grijesh Choudhary struck the informant's husband with a tangi on his head as a result of which he died in course of treatment.

It is submitted by learned counsel for the appellant that the allegations as levelled in the FIR are false and concocted. There is case and counter case between the parties. The allegations against the appellant are general and omnibus in nature. The appellant is in custody since 26.2.2021 and investigation in the case has concluded. Further co-accused Chandrika Ram has been enlarged on bail vide order dated 26.8.2021 passed in Cr. Appeal (SJ) no. 2166 of 2021 and Bechu Ram has been enlarged on bail vide order dated 4.5.2021 passed in Cr. Appeal (SJ) no. 655 of 2021.

Heard learned Special PP for the State.

Having heard learned counsel for the parties and taking into consideration the facts and circumstances of the case, the order impugned dated 19.3.2021 is set aside and the appeal is allowed.

The appellant is directed to be enlarged on bail in connection with Bagha P.S. Case no. 407 of 2020 on furnishing

Patna High Court CR. APP (SJ) No.3428 of 2021(2) dt.07-09-2021 3/3 bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned 1st Additional Sessions Judge-cum-Special Judge, SC/ST, Bettiah, West Champaran.
