JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 29-04-2016 Heard learned Counsel for the petitioners and learned Additional Public Prosecutor for the State. This application, for grant of anticipatory bail, arises out of Kako Police Station Case No. 161 of 2015, disclosing offence under Sections 147, 148, 307 and 379 of the Indian Penal Code.

Learned Counsel for the petitioners has submitted that there is specific allegation of assault against co-accused Shrikant Mistry, who has been granted regular bail by this Court, vide order, dated 15.02.2016, passed in Criminal Misc. No. 5514 of 2016. He has produced before me, a web copy of the said order, let the same be kept on

Patna High Court Cr.Misc. No.14747 of 2016 (2) dt.29-04-2016 2/2 record.

Considering the submission that co-accused, Shrikant Mistri, has been granted bail and the case of these petitioners is on better footing, this application is allowed. Let the petitioners, namely, Gajablal Mistri, Ram Ratiya Devi, Priti Kumari @ Priti Devi, Switi Kumari and Asmita Kumari, in the event of their arrest or surrender before the Court below within six weeks, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Jehanabad, in connection with Kako Police Station Case No. 161 of 2015, subject to the condition laid down under Section 438

(2) of the Code of Criminal Procedure.

This is subject to the condition that the petitioners shall present themselves before the police/Court, as the case may be, as and when required and in the event of failure on their part to appear before the Court on two consecutive occasions, their bail bonds shall be liable to be cancelled.
