The petitioner is in custody in connection with Dhanaha P.S. Case No. 61of 2019 for the offence under Section 414 of the Indian Penal Code and Section 30(a) of the Bihar Prohibition and Excise Act, 2016.

Learned counsel for the petitioner submits that it is surprising that the driver, who was plying the vehicle carrying liquor was allowed to escape and this petitioner has been made scape goat. He further submits that the petitioner has got no criminal antecedent and he is in custody since 09.04.2019. He further submits that in the instant case total 138 litres of liquor was seized.

Considering the fact that the petitioner has got no criminal antecedent, the petitioner, named above, is directed to

Patna High Court CR. MISC. No.35260 of 2019(2) dt.29-05-2019 2/2 be released on bail on furnishing bail bonds of Rs.10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of Special Judge, Excise Act, Bettiah, West Champaran in connection with Dhanaha P.S. Case No. 61of 2019.
