Admittedly, the entire retiral dues except part amount of G.P.F. has already stood paid to the widow petitioner, as is also borne out from the order of this Court dated 25.11.2020. It would be relevant to reproduce paragraph
Patna High Court CWJC No.6417 of 2018(22) dt.20-06-2022 2/3 no. 2 of the said order dated 25.11.2020, hereinbelow :- "2. At the outset, the learned counsel for the petitioner submits that the retiral benefits of her husband have been received, save and except that G.P.F. has not been calculated in a proper manner on the basis of his last pay drawn at Rs. 68,000/-, as evident from P.P.O. No. 202012051377."
As far as the outstanding amount of G.P.F. is concerned, the learned counsel for the respondent State has submitted that since the entire salary statement of the petitioner pertaining to the places where he had been posted has not yet been received, the payment of the outstanding G.P.F. amount is still pending.
In such view of the matter, this Court deems it fit and appropriate to direct the respondents to obtain the entire records pertaining to the deceased employee i.e. the husband of the petitioner herein, within a period of four weeks from today and make payment of the balance outstanding amount of G.P.F., failing which the Principal Secretary, Department of Education, Government of Bihar, Patna shall not draw his salary.
