The petitioner is languishing in custody since 31.07.2018 in a case registered for the offences punishable under Sections 392 and 395 of the IPC.

The prosecution case is that on 05.12.2017, while the informant was travelling by train, his articles were robbed, leading to registration of FIR against unknown persons. The name of the petitioner sprang up during investigation on the confession of apprehended co-accused, Jallu Kumar @ Abhishek.

It is submitted by learned counsel for the petitioner that no recovery has been made from the conscious physical possession

Patna High Court CR. MISC. No.34733 of 2019(2) dt.28-05-2019 2/2 of the petitioner and the petitioner has not been put on T.I. parade. A statement has been made in paragraph no.3 of the petition that the petitioner is also accused in three other cases, in which, he is on bail.

Learned APP submits that the name of the petitioner sprang up on the confession of apprehended co-accused. Considering the fact that no recovery has been made from the conscious physical possession of the petitioner, petitioner has not been put on T.I. parade and the investigation has already been concluded, let the above named petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of like amount each to the satisfaction of learned ADJ_IV, Patna in connection with G.R.P. Bakhtiyarpur P.S. Case No. 229 of 2017.
