The petitioner seeks bail in anticipation of his arrest in connection with Sahiyara P.S. Case No.74 of 2019 instituted for the offences under Sections 399 and 402 of the Indian Penal Code & Sections 25(1-b)a, 26 and 35 of the Arms Act. Learned counsel for the petitioner submits that at the place where other persons have been arrested with pistol and live cartridges have taken the name of the petitioner. In the circumstances, it cannot be said that a case under section 399 and 402 of the Indian Penal Code is made out against the petitioner.

Having considered the submission and F.I.R, I am inclined to grant benefit of anticipatory bail to the petitioner and
