JUSTICE DINESH KUMAR SINGH ORAL ORDER 29-03-2016 Heard learned counsels for the petitioners and the State. The petitioners are apprehending arrest in a case registered for the offences punishable under Sections 147,148,323,324,307,325,379 and 504 of the Indian Penal Code. The prosecution case is that in the background of land dispute, it is alleged that the petitioner no. 1 Abhay Kumar assaulted with farsa to Jai Chandra, the informant and Sheopujan Prasad, the brother of the informant. Both the injured have received grievous injuries.
It is submitted by learned counsel for the petitioners that all the injuries have been found to have been caused by hard and blunt substance. It is further submitted that there is no specific accusation of assault against the petitioner no. 2. Statement has

Considering the accusation not being corroborated by the medical opinion, let the above named petitioners be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned SDJM, Sikrahana in connection with Chiraiya P.S. Case No.264 of 2015 subject to the conditions as laid down under Section 438(2) Cr.P.C.
