JUSTICE NAWNEET KUMAR PANDEY ORAL ORDER 03-07-2023 Heard the learned counsel for the petitioner as well as the learned Additional Public Prosecutor for the State. The petitioner is seeking regular bail in connection with Ahiyapur P.S. Case No. 692 of 2020, registered for offence punishable under section 395 of the Indian Penal Code, in which charge-sheet has been submitted under sections 395/412 of the Indian Penal Code.

As per allegation, six unknown accused persons on three motor-cycles came and looted away Rs. 26,45,000/- (twenty six lakhs, forty five thousand rupees) from the possession of the informant.

The learned counsel for the petitioner has submitted that except confessional statement of co-accused Lalit Sahni,

Patna High Court CR. MISC. No.37677 of 2023(2) dt.03-07-2023 2/2 there is nothing against the petitioner. Co-accused Lalit Sahni has been granted bail, vide Cr. Misc. No. 43884 of 2021 and other co-accused Arjun Sahni has been granted bail in Cr. Misc. No. 23711 of 2023. Nothing was recovered from the possession of the petitioner and he is under custody since 09.06.2022. Considering the above-mentioned facts and circumstances, let the petitioner above-named be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand rupees) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate 1st Class, Muzaffarpur (East) in connection with Ahiyapur P.S. Case No. 692 of 2020, subject to the following conditions:- (i) The petitioner shall cooperate in the disposal of trial and make himself available as and when required by the court.

(ii) If the petitioner is found involved in future in the similar type of offence, his bail bond shall be liable to be cancelled.
