2. The petitioner seeks regular bail in connection with Parsa Bazar P.S. Case No. 521 of 2025 registered for the offence under Sections 303(2), 317(2), 317(4), 317(5) & 3(5) of the B.N.S., 2023 read with Section 18(C) of the Drugs & Cosmetic Act.

3. As per the prosecution case, the petitioner is alleged to have been selling narcotic substances and stolen mobile phones from his house.

4. Learned counsel for the petitioner submits that the petitioner is quite innocent and has not committed any offence. The petitioner is in custody since 18.12.2025 having three criminal antecedents.

5. Learned A.P.P. for the State has vehemently opposed the prayer for bail and submits that there is huge recovery of mobile phones from the conscious possession of the petitioner.

6. Considering the huge recovery of mobile phones and also the fact that the petitioner is a member of gang involved in giving poisonous substance to the innocent, traveling in the train and thereafter looting them, I am not inclined to grant bail to the petitioner.

7. Accordingly, this application is dismissed.

8. It is made clear that any observation made herein is prima facie in nature and limited solely for the purpose of adjudication of the present bail application. Such observations shall not be construed as an expression on the merits of the case and shall not influence the trial or any other proceedings in any manner.
