The petitioner is apprehending his arrest in a complaint case in which processes have been directed to be issued after cognizance being taken for the offences punishable under Section 406 of the Indian Penal Code and 3/4 of the Dowry Prohibition Act.
It is alleged that the marriage of the daughter of the complainant was fixed with the son of the petitioner. When engagement was performed, the complainant spent Rs. 1,000,00/- including gifts and cash. Subsequently the date of marriage was fixed, but further demand of Rs. 3,000,00/- was made by the petitioner and marriage was not performed.
Patna High Court Cr.Misc. No.8720 of 2015 (2) dt.02-03-2015 It is submitted by the learned counsel for the petitioner that petitioner filed the Informatory Petition on 09.01.2013 and Complaint Case No. 65 of 2013 on 14.01.2013 with accusation under Sections 148, 323, 392, 379, 504/34 of the Indian Penal Code against the complainant, thereafter the present complaint was filed on 17.01.2013.
Considering the nature of accusation and the filing of Informatory Petition and complaint case by the petitioner at the earlier point of time, let the above named petitioner be released on anticipatory bail in the event of his arrest or surrender before the learned court below within a period of twelve weeks from today, on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Sub-Divisional Judicial Magistrate, West (Muzaffarpur) in connection with Complaint Case No. 82 of 2013, subject to conditions as laid down under Section 438(2) of the Indian Penal Code.
