Learned Counsel for the petitioner submits that the present writ petition has been filed with the following reliefs:- i) For issuance of an appropriate writ(s) thereby quashing and setting aside the order as contained in Memo No. 913 dated 03.06.2024 issued under the seal and signature of the Respondent No. 5 by which petitioner's Niyojan as
Patna High Court CWJC No.10060 of 2025(2) dt.01-07-2025 2/3 Vikash Mitra in Godhna Panchayat, Block Bachwara District Begusarai has been cancelled and the said post has been declared as vacant on the ground of alleged absenting from duty without information.
ii) For consequently direction upon the respondents to reinstate the petitioner as Vikash Mitra in Godhna Panchayat Block Bachwada, District Begusarai.
iii) For also direction upon the respondents to grant all the consequential benefits to the petitioner which may accrue on account of her reinstatement as Vikash Mitra.
3. Counsel for the petitioner further submits that due to unavoidable difficult situation, the petitioner could not attend the office of Vikash Mitra in Godhna Panchayat, Block Bachwara, Begusarai and without following the due process, she has been removed from the said post.
4. Counsel for the State submits that liberty is available to the petitioner under the fodkl fe+= % p;u ekxZnf"kZdk to move before the District Magistrate. He further submits that the District Magistrate is entitled to look after the selection process and if any person has been removed without following the principle of natural justice that is claimed by the petitioner, then power lies on the person, who has been empowered under law to make supervision of the selection process.

In the light of the submissions made, the present writ petition is hereby disposed off directing the petitioner to file a fresh representation raising all her grievances before the District Magistrate, Begusarai (respondent No.4) within 30 days along with this order and the respondent No.4 after hearing all concerned, shall pass a reasoned and speaking order within 90 days after receiving the same thereafter. It is made clear that the said 90 days shall be counted after appearance of all concerned.
