The petitioner is in custody since 04.04.2019 in connection with Garkha P.S. Case No. 201/2019 registered for the offence punishable under Sections 379 of the Indian Penal Code.

Learned counsel for the petitioner submits that though the alleged recoveries of tempo was not from the conscious possession of the petitioner, but was found parked behind his house and the petitioner has been taken into custody on suspicion. It is further submitted that the petitioner was having differences with regard to payment of wages as he is the driver of the tempo in question and the informant has named him later on for the said reason.

Considering the aforementioned facts and circumstances and that the petitioner has got no criminal

No.39197 of 2019(4) dt.16-09-2019 2/2 antecedent, let the petitioner above named be released on bail, on furnishing bail bonds of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned ACJM, XIV, Saran at Chapra, in connection with Garkha P.S. Case No. 201/2019.
