JUSTICE SHIVAJI PANDEY ORAL ORDER 11-04-2017 Heard learned counsel for the petitioner and learned counsel for the State.

In the present case, petitioner is claiming for payment of Rs.32,91,323/-.

As has been claimed by the petitioner he has constructed 14 KM of NH 80 from Batamore towards Lakhisarai. The value of work was Rs.5,39,00,216/- and after final construction, as has been claimed, he has handed over the constructed road but final bill has not been paid to him.

Patna High Court CWJC No.3815 of 2017 (2) dt.11-04-2017 In such view of the matter, petitioner is directed to file a detailed representation before the Principal Secretary-cumCommissioner, Road Construction Department, Government of Bihar, Patna along with supporting documents and Principal Secretary-cum-Commissioner is directed to examine the case of the petitioner and if it is found that the petitioner is entitled for the same he will release the fund within a period of three months from the date of filing of the representation. If Principal Secretary-cum-Commissioner does not find favour with the petitioner he will pass a reasoned order. With the aforesaid observation and direction this writ petition is disposed of.
