2. The petitioner has preferred this application for grant of regular bail in connection with Sitamarhi cyber P.S. Case No. 33 of 2024 dated 31.03.2024 registered for the offence punishable under Sections 255, 406, 420, 467, 468, 471 and 120B of the Indian Penal Code and Sections 66(c), 66(d) of I.T. Act.
3. As per the prosecution case, the petitioner and the co-accused persons are alleged to have committed forgery in illegally withdrawing money from the Bank Accounts of innocent people by taking their thumb impression.
4. Learned counsel for the petitioner has submitted
Patna High Court CR. MISC. No.44816 of 2024(2) dt.16-07-2024 2/2 that the petitioner is innocent and has falsely been implicated in this case. The name of the petitioner has sprung up in this case in the confessional statement of the co-accused Ramesh Kumar. No incriminating article has been recovered from the conscious possession of the petitioner. It is further submitted that petitioner has not indulged in the alleged offence of committing forgery. There is general and omnibus allegation against the petitioner. The petitioner has antecedent of one case as stated in para 3 of the bail petition. The petitioner is in custody since 01.04.2024.
5. Learned A.P.P. for the State has vehemently opposed the bail petition of the petitioner.
6. Considering the aforesaid facts and circumstances of the case as well as the period of custody, the petitioner abovenamed, is directed to be enlarged on bail on furnishing bail-bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court concerned, Sitamarhi in connection with Sitamarhi Cyber P.S. Case No. 33 of 2024.
7. The application stands allowed.
