2. The petitioners have prayed for bail in connection with Chakiya P.S. Case No. 73 of 2024 registered for the offence punishable under Sections 103(1), 238 and 3(5) of the B.N.S.
3. The case of the prosecution, in short, is that the son of the informant was missing. After some time, the dead body of the son of the informant was found in a ditch. His head and leg were found in a ditch of another place. It is alleged that

4. Learned counsel appearing on behalf of the petitioners has submitted that petitioners are innocent and have committed no offence. They have been falsely implicated in this case. Their names were not there in the F.I.R. During investigation, one Subid Kumar has given his confessional statement and on the basis of the confessional statement, names of these petitioners have surfaced in this case. It has also been submitted that Subid Kumar has been granted bail by learned Co-ordinate Bench of this Court vide order dated 20.08.2025 in Cr. Misc. No. 31636 of 2025. It has also been submitted that save and except for the confessional statement of Subid Kumar, nothing is against these petitioners. The case of these petitioners stands on better footing than that of Subid Kumar. They are having no criminal antecedent. They are languishing in judicial custody since 28.01.2025.
5. The application for bail is opposed by learned APP for the State.
6. Having heard learned counsel for the parties and considering the facts and circumstances of the case, this Court is inclined to enlarge the petitioners on bail. The above named petitioners are directed to be enlarged on bail on furnishing bail
Patna High Court CR. MISC. No.36673 of 2025(3) dt.01-09-2025 3/3 bond of Rs. 10,000/- (Rs. ten thousand only) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Begusarai in connection with Chakiya P.S. Case No.73 of 2024.
