JUSTICE DINESH KUMAR SINGH ORAL ORDER 29-03-2016 Heard learned counsels for the petitioners and the State. The petitioners being brothers and mother of the husband of informant are apprehending arrest in a case registered for the offences punishable under Section 341, 323, 313, 498A/34 of the Indian Penal Code and under Section 3⁄4 of Dowry Prohibition Act.
The basic accusation is of torture for non fulfillment of dowry demands.
It is submitted by the learned counsel for the petitioners that accusation of torture is omnibus and general against the petitioners. The thrust of accusation is against the husband of
Patna High Court Cr.Misc. No.13742 of 2016 (2) dt.29-03-2016 2/2 informant, who has been allowed provisional anticipatory bail by this court, as during the hearing of the bail petition the informant and his husband agreed to resolve their dispute. Considering the aforesaid facts, let the above named petitioners be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned SDJM, Sadar, Motihari in connection with Mehsi P.S. Case No. 150 of 2014, Tr. No. 1755 of 2016 subject to the conditions as laid down under Section 438(2) Cr.P.C. (Dinesh Kumar Singh, J) BKS/- U T
