The petitioner apprehends his arrest in Gamharia P.S. Case No. 63 of 2014, registered for the offences punishable under Sections 302, 307 and other Sections of the Indian Penal Code. Yugeshwar Yadav the informant made allegation against Shambhu Yadav, Shatrughan Yadav and Bhushan Yadav that they assaulted Satya Narayan Yadav. Thereafter the petitioner and other accused persons are alleged to have assaulted the informant and other family members.

Learned counsel for the petitioner submits that there is no specific allegation against the petitioner. The petitioner is not the assailant of the deceased.

On the other hand, learned counsel for the informant

Patna High Court Cr.Misc. No.6759 of 2015 (2) dt.19-02-2015 2/2 while opposing the prayer for anticipatory bail submitted that the petitioner is alleged to have assaulted the informant and other family members. The informant got many injuries on the head and other parts of the body.

Considering the facts aforesaid and the fact that the accused persons are alleged to have assaulted the deceased Satya Narayan Yadav, the informant and his family members, I am not inclined to enlarge the petitioner on anticipatory bail. Accordingly, the same is rejected.
