JUSTICE MOHIT KUMAR SHAH ORAL ORDER 18-07-2022 Though the present writ petition has been filed for directing the respondents not to interfere with the peaceful possession of the petitioner over the land appertaining to M.S. Khata No. 315, M.S. Plot No. 316, 317 area about 2 katha 10 dhur, situated at village-Makrini, P.S. Dehri, District-Rohtas but in view of the fact that the petitioner has already filed a title suit bearing Title Suit No. 479 of 1996 which though has stood dismissed for default, however, an application for Restoration of the said suit has been filed which is still pending, liberty is sought on behalf of the petitioner to permit him to pursue his remedy before the learned court below.

Accordingly, the preset writ petition stands disposed off as not pressed, however, with the aforesaid liberty to the petitioner.
