The petitioner seeks pre-arrest bail in connection with Chenari P.S. Case No. 243 of 2015 registered under Section 7 of the Essential Commodities Act.
It is contended that the prosecution case is vague and does not disclose as to which provision of the control order has been violated by the petitioner which is pre-condition for launching prosecution under Section 7 of the Essential Commodities Act, 1955.
Learned counsel for the State has opposed the
Patna High Court Cr.Misc. No.13828 of 2016 (2) dt.01-04-2016 2 / 2 application for grant of pre-arrest bail to the petitioner. Be that as it may, regard being had to the nature of the offence, in the event of arrest or surrender in the court below within six weeks from today, the petitioner is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial MagistrateVII, Sasaram, Rohtas in connection with Chenari P.S. Case No. 243 of 2015 subject to the conditions as laid down under Section 438(2) Cr. P.C.
