22-11-2021 Heard learned counsel for the parties.

The petitioner seeks bail in Ishachak P.S. Case No. 91 of 2020 (G.R. No. 2925 of 2020), registered for the offence under Section 394 of the Indian Penal Code.

As per F.I.R., on 06.03.2020 at about 8:50 PM, while the informant was closing his shop, in the meanwhile, three miscreants riding on a motorcycle, on the point of weapon, they took out Rs. 35,000/- from the informant's pocket, some cash from the cash counter of shop and mobile phone of informant. It is further alleged that one of the miscreants assaulted the informant on his head by butt of pistol and thereafter, all accused fled away.

Petitioner is not named in the FIR. Name of the petitioner has transpired on the basis of confessional statement

Patna High Court CR. MISC. No.47701 of 2021(2) dt.22-11-2021 2/2 of co-accused Umang Kumar Sah. No incriminating article has been recovered from the possession of the petitioner. Till date, petitioner has not been put on T.I.P. and he is in custody since 21.09.2020. Chargesheet has been submitted.

Learned A.P.P. for the State has opposed the bail petition.

Considering the aforesaid facts and circumstances, the bail petition of petitioner is allowed. Let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned J.M. 1st Class, Bhagalpur in connection with Ishachak P.S. Case No. 91 of 2020 (G.R. No. 2925 of 2020).
