The petitioner has preferred this application for grant of regular bail in a case registered under section 392 of the Indian Penal Code.

As per the prosecution case, four accused persons looted various articles including the mobile phone, Aadhar card etc. of the informant and others.

It is submitted by learned counsel for the petitioner that the F.I.R. was registered against unknown. The name of the petitioner transpired in the confessional statement of co-accused Md. Akhlak who has himself been enlarged on bail vide order dated 19.2.2020 passed in Cr. Misc. no. 86382 of 2019. The petitioner is in custody since 17.11.2018 and has not been put on

Patna High Court CR. MISC. No.47715 of 2021(4) dt.08-03-2022 2/2 T.I.Parade. There is no chance of the trial concluding in the near future.

Heard learned A.P.P. for the State.

A report was called for from the learned trial Court. As per the report received, the case is pending for evidence of prosecution.

Having heard learned counsel for the parties and taking into consideration the facts of the case together with the petitioner having remained in custody for over 3 years, the Court directs the petitioner to be enlarged on bail in connection with Kotwali (Tilkamanjhi) P.S. Case no. 576 of 2018 on furnishing bail bond of Rs.10,000/ (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Sub-Judge X-cumAdditional Chief Judicial Magistrate IX, Bhagalpur.
