ANJANA MISHRA ORAL ORDER 26-04-2016 Heard learned counsel for the petitioner, BSFC and learned counsel for the State.

The petitioner apprehends his arrest in connection with Lakhisarai P.S. Case No. 281 of 2015 registered for the offences punishable under Sections 420, 406 and 409 of the Indian Penal Code and Section 7 of the E.C. Act, 1955.

The allegation against the petitioner is that of defalcation of CMR worth Rs. 69,52,746.93 and out of said amount, the petitioner has already deposited Rs. 6,50,000/- In view of the fact that the petitioner is willing and ready to deposit 20 per cent of the alleged defalcated amount within a period of three months, let the petitioner above named,

Patna High Court Cr.Misc. No.13380 of 2016 (3) dt.26-04-2016 in the event of their arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, is/are directed to be enlarged on bail on furnishing bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Lakhisarai in connection with Lakhisarai P.S. Case No. 281 of 2015, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.

However, it is made clear that the amount already deposited by the petitioner, shall be included with the said 20 percent amount deposited by him. It is also made clear that that the petitioner shall make himself available as and when required for further investigation and shall not linger the investigation, in any manner.
