The petitioner is apprehending her arrest in a case registered for the offences punishable under Sections 147, 148, 149, 120B, 302 of the Indian Penal Code and 27 of the Arms Act.
The informant, her husband and son went to field then Parmeshwar Yadav, Nandu Yadav, Bikram Yadav, Dinesh Yadav, Munshi Yadav fired at the husband of the informant. The husband of the petitioner is in custody for committing the murder of the other son of the informant, hence this petitioner at the instance of her husband hatched the conspiracy. It is submitted by the learned counsel for the petitioner that as per the First Information Report itself the petitioner is not the assailants and only accusation is of
Patna High Court Cr.Misc. No.6193 of 2015 (2) dt.16-02-2015 criminal conspiracy.
Considering the fact that petitioner is lady and accusation of assault is not against this petitioner, let the above named petitioner be released on anticipatory bail in the event of her arrest or surrender before the learned court below within a period of twelve weeks from today, on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, Ist Class, Lakhisarai in connection with Halsi P.S. Case No. 71 of 2014, subject to conditions as laid down under Section 438(2) of the Indian Penal Code.
