The petitioner apprehends his arrest in a case under Section 341, 342, 323, 326(A), 307, 376/511 of the Indian Penal Code.
The informant alleged that while she was in her house Subodh Yadav, son of the petitioner, came and made her naked and tried to outrage her modesty. In the meantime, an unknown person came and threw acid which fell on the body of Subodh Yadav and she also got some injuries. It is alleged that petitioner, father of Subodh Yadav, on alarm, came and dragged the informant to his house and tied her with a rope and also assaulted her.
Sri B. P. Pandey, the learned senior counsel
Patna High Court Cr.Misc. No.13220 of 2016 (3) dt.28-06-2016 2/2 appearing for the petitioner, submits that none of the witnesses saw the petitioner assaulting the informant. There is no injury on the body of informant but it appears that the informant has made very specific allegation that it was the petitioner who came on alarm and dragged her to his house and tied her with a rope and assaulted her.
Considering the facts aforesaid and the nature of allegations made against the petitioner, I am not inclined to enlarge the petitioner on anticipatory bail. Accordingly, the same is rejected.
