JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 24-03-2015 Heard learned counsel for the petitioner as well as leaned Additional Public Prosecutor for the State. The petitioner apprehends his arrest in connection with Nawada P.S. Case No. 474 of 2013 registered under Sections-.153A, 295A, 379, 535 & other minor sections of the Indian Penal Code.
The petitioner is not named in the first information report and it appears from the impugned order that his name came in this case in confessional statement of co-accused, Prahlad Kumar.
The contention on behalf of the petitioner is that having more or less similar allegation, two persons have already been granted privilege of anticipatory bail by coordinate bench of
Patna High Court Cr.Misc. No.11420 of 2015 (2) dt.24-03-2015 this court vide order dated 20-05-2014 passed in Cr. Misc. No. 11244 of 2014.
Taking note of the aforesaid facts and circumstances as well as submission of the parties, let the petitioner named above, in the event of his arrest or surrender within four weeks from the date of receipt/production of copy of the order in the court below, be released on bail on furnishing bail bonds of Rs 10,000/- (ten thousand) with two sureties of the like amount each in connection with Nawada P.S. Case No. 474 of 2013 to the satisfaction of learned Chief Judicial Magistrate, Nawada subject to the conditions as laid down u/S 438(2) of the Cr. P.C. (Hemant Kumar Srivastava, J) A.K.V./- U T
