====================================================== CORAM: HONOURABLE MR. JUSTICE SHIVAJI PANDEY ORAL ORDER 08-03-2021 Heard learned counsel for the petitioners and learned counsel for the State.

In this case, the petitioners are seeking anticipatory bail in connection with Mahila P.S. Case No. 37 of 2019 registered for offence punishable under sections 406, 409, 420 of the Indian Penal Code and section 3/4 of the Dowry Prohibition Act. It has been stated in paragraph 12 of this application that petitioner no. 1 is married sister, petitioner no. 2 is bhabhi and petitioner no. 3 is brother-in-law(Bahnoi) of Balwant Kumar, who is said to be prospective husband of the informant. The marriage broken on account of demand of money and other valuable articles.

Patna High Court CR. MISC. No.34450 of 2020(2) dt.08-03-2021 2/2 Learned counsel for the petitioners submits that whatever the informant had given in the name of Barat that has been returned to her. He further submits that the petitioners had no concern with the marriage of the informant and her prospective husband.

Looking to the facts and circumstance of the case, let the petitioners above named, in event of arrest or surrender before the court below within six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- each with two sureties of the like amount each to the satisfaction of 1st Additional Chief Judicial Magistrate-cum-Sub Judge, East Muzaffarpur in connection with Mahila P.S. Case No. 37 of 2019, subject to the condition that one of the bailors of the petitioners shall be their close relative. The petitioners will not induce any witness or tamper with the evidence and they shall cooperate in the disposal of trial and make themselves available as and when required by the court. In case of failure on two consecutive dates without any valid reason, the court below will be at liberty to cancel the bail bonds of the petitioners.
