The petitioner apprehends his arrest in Sonbarsa P.S. Case no. 01 of 2015, registered for the offences punishable under Section 409 of the Indian Penal Code.

B.P.L. list of the year 1997 of Sonbarsa, allotment list of food grains from August 1997 to June 1998, Panchayat wise list of distribution of Red Cards and the Inspection Report prepared by Raja Ram Choudhary, the then Anchal Adhikari from November 1997 to June 1998 were called for from the Block Supply Officer, Sonbarsa. The petitioner was posted as Block Supply Officer, Sonbarsa on transfer from Keoti, Darbhanga and was relieved

Patna High Court Cr.Misc. No.13682 of 2015 (2) dt.07-05-2015 from Keoti vide letter contained in memo no. 1339 dated 09.07.2012 and submitted his joining to the Collector, Sitamarhi. The petitioner received the letter on 7.02.2014 vide letter no. 158 issued under the signature of the Deputy Collector (Establishment), Sitamarhi, but those documents could not be traced out.

It is submitted that the petitioner did not receive any documents while taking over the charge.

Considering the facts aforesaid, the petitioner above named in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on anticipatory bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Sitamarhi in connection with Sonbarsa P.S. Case No. 01/2015, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. (Prabhat Kumar Jha, J.) Rakhi/- U T
