====================================================== CORAM: HONOURABLE MR. JUSTICE KHATIM REZA ORAL ORDER 07-07-2023 Heard learned counsel for the petitioner and learned A.P.P. for the State.

2. The petitioner seeks bail in connection with Khusrupur P.S. Case No. 330 of 2022 dated 27.08.2022, instituted for the offences punishable under Sections 302, 34 of the Indian Penal Code and 27 of the Arms Act.

3. As per the prosecution case, the F.I.R. has been lodged against twenty named accused persons and the specific allegation is against one Rajendra Prasad @ Baudhu who has fired on the head of informant's mother due to which she died.

4. Learned counsel for the petitioner submits that the petitioner is innocent and he has falsely been implicated in

Patna High Court CR. MISC. No.37856 of 2023(2) dt.07-07-2023 2/3 this case. It is submitted that there is no allegation against the petitioner. It is further submitted that there is specific allegation the said Rajendra Prasad. It is further submitted that the petitioner is aged about 23 years and have clean antecedent. Further, it is submitted that other similarly situated persons, namely, Rana Singh and Suresh Singh have been granted regular bail by a co-ordinate Bench of this Court in Cr. Misc. No. 35740 of 2023 vide order dated 24.06.2023 and in Cr. Misc. No. 16187 of 2023 vide order dated 10.05.2023. It is further submitted that another co-accused, namely, Dewan Singh, has been granted anticipatory bail in Cr. Misc. No. 23694 of 2023 vide order dated 24.06.2023. Lastly, it has been submitted that the petitioner is in custody since 12.12.2022 and charge-sheet has been submitted in the case.

5. Learned A.P.P. has opposed the prayer for bail of the petitioner.

6. Having considered the facts and circumstances of the case and submissions of learned counsel for the parties, let the petitioner be released on bail upon furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like
