The petitioner is apprehending arrest in a case registered for the offences punishable under sections 382,504 and 506/34 of the Indian Penal Code and section 3(1)(x) of the Scheduled Caste and Scheduled Tribe (Prevention of Atrocities) Act.

The prosecution case is that the accused persons were taking away the she-buffalo and the calf when on the instigation of co accused Pappu Yadav, the petitioner caught hold of the informant when accused persons abused the informant by calling caste name, assaulted and took away his cattle. No.12536 of 2016 (2) dt.17-03-2016 2/2 petitioner that even assuming the accusation no offence under the Scheduled Caste and Scheduled Tribe (Prevention of Atrocities) Act is made out against the petitioner. Statement has been made in paragraph 3 of the petition that the petitioner has no criminal antecedent.

The aforesaid facts constitute ground for consideration of the prayer for regular bail of the petitioner by the learned court below in case the petitioner surrenders within six weeks from today in connection with Shahpur P.S. Case No. 383 of 2015 pending in the court of learned JM, Bhojpur at Ara. This application is disposed of with the aforesaid observation/direction.
