JUSTICE SUNIL KUMAR PANWAR ORAL ORDER 04-07-2023 Heard learned counsel for the petitioner, learned counsel for the informant and learned APP for the State. The petitioner has prayed for bail in a case registered for the offence punishable under sections 341, 323, 504, 506, 324, 307, 379 of the Indian Penal Code.
As per allegation in the FIR, with an intention to kill, petitioner has given a knife blow to the informant as a result of which he received injury over his neck while she was returning from market to her house by electronic three wheeler. It is further alleged that miscreants snatched her golden chain and fled away.
It is submitted by learned counsel for the petitioner that petitioner has been falsely implicated in this case. Both

Injury report is not in consonance with the prosecution story as doctor has opined nature of injury is simple caused by hard and blunt object, whereas allegation is of giving knife blow upon the neck of the informant. Petitioner has got no criminal antecedent and languishing in judicial custody since 10.04.2023.
The application for bail is opposed by learned APP for the State and learned counsel for the informant. Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand only) with two sureties of the like amount each to the satisfaction of the learned CJM, Samastipur in connection with Samastipur Town P.S. Case No. 89 of 2023.
