The petitioner is apprehending arrest in a case registered for the offences punishable under sections 414/34 of the Indian Penal Code.

It is alleged that two persons were tried to be intercepted while travelling on motorcycle the driver was caught but the pillion rider managed to flee away. The person who was apprehended disclosed the name of pillion rider as Bhim Yadav, the petitioner. The motorcycle was found to be stolen one. It is submitted by the learned counsel for the petitioner that only on suspicion and only on confession of co accused the petitioner has been roped in the present case.

Patna High Court Cr.Misc. No.12535 of 2016 (2) dt.17-03-2016 2/2 Admittedly the petitioner was a pillion rider. It is further submitted that though the petitioner is accused in three other cases but he is on bail in those cases.

The aforesaid facts constitute ground for consideration of the prayer for regular bail of the petitioner by the learned court below in case the petitioner surrenders within six weeks from today in connection with Chowk P.S. Case No. 164 of 2015 pending in the court of learned JM Ist Class, Patnacity. This application is disposed of with the aforesaid observation/direction.
