The petitioner seeks bail in anticipation of his arrest in connection with Mairwa P. S. Case No. 137 of 2020, dated 09.05.2020, instituted for the offence under Section 30(a) of the Bihar Prohibition and Excise Act, 2016.

Patna High Court CR. MISC. No.35172 of 2020(2) dt.23-03-2021 2/3 8 litres of liquor is said to have been recovered from a bag kept near a motor-cycle. It was suggested to the raiding team that petitioner and two others had run away from the place of raid.

The learned counsel for the petitioner has submitted that neither the motor-cycle nor the liquor belongs to him. He has been made accused in this case only on the stray information provided by some onlookers.

The petitioner does not have criminal antecedents.

Considering the afore-stated facts, the petitioner, above-named, is directed to be released on bail, in the event of his arrest or surrender before the court below within a period of eight weeks from the date of receipt / production of a copy of this order, on his furnishing bail bonds in the sum of Rs. 10,000 /- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional District and
