2. The petitioners seek regular bail in connection with Pasraha P.S. Case No. 182 of 2023 registered for the offence under Sections 302, 342, 323, 341, 34 and 120B of the Indian Penal Code.

3. As per the prosecution case, for a land dispute, 13 accused persons including the petitioners are said to have assaulted the victim.

4. So far as the petitioner no. 1 namely Fulo Singh @ Fuleshwar Kumar is concerned, there is specific allegation of assault against him and he is identified as one of the assailants.

5. Considering the fact that the petitioner no.1 namely Fulo Singh @ Fuleshwar Kumar is one of the assailant of the deceased, I am not inclined to grant regular bail to the petitioner no. 1 namely Fulo Singh @ Fuleshwar Kumar.

6. Accordingly, the prayer of the petitioner no. 1 namely Fulo Singh @ Fuleshwar Kumar for regular bail is hereby rejected.

7. So far as the petitioner no. 2 namely Chandra Dev Singh is concerned, the learned counsel for the petitioner submits that he is innocent and has not committed any offence. He further submits that the petitioner no. 2 is in custody since 17.12.2024 and he is the member of the mob and there is no specific allegation of assault against him.

8. Considering the aforesaid facts and circumstances, the prayer of the petitioner no. 2 for regular bail is allowed.

Accordingly, let the petitioner no. 2 namely Chandra Dev Singh, be released on regular bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned A.D.J.- VII, Khagaria/concerned Court below in connection with Pasraha P.S. Case No. 182 of 2023 subject to conditions that:-

Patna High Court CR. MISC. No.40815 of 2025(3) dt.16-02-2026 3/3 (i). The petitioner shall appear in the trial regularly either personally or through his lawyer and shall cooperate in the trial and non-cooperation in the trial shall result in cancellation of the bail bond of the petitioner.

10. With the aforesaid observation and direction, this application is partly allowed.
