The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 30(a), 35 and 38 of the Bihar Prohibition and Excise Act, 2016. The prosecution case is that 1.260 liters of foreign liquor was recovered from the shop of the co-accused. The contention of the petitioner is that the name of the petitioner has been disclosed by co-accused Rajesh Prasad Gupta. Nothing has been recovered from the possession of the petitioner. Petitioner is having no criminal antecedent. Considering the facts aforesaid, let the petitioner above named, in the event of his arrest or surrender before the

Case No. 20 of 2019, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure as well as condition that the petitioner shall fully cooperate with the investigation and trial of the case, failing which the court below shall be at liberty to cancel the bail bonds of the petitioner.
