Earlier the prayer for bail of the appellants was rejected by this Court, vide judgment dated 18.5.2017 passed in Cr. Appeal No.1216 of 2017.
There is allegation against the appellant and other accused persons of kidnapping of the minor daughter of the informant.
It is submitted that the petitioner is in custody since 3.7.2017 and except suspicion nothing has come against the appellant and the similarly situated other accused persons have been gratned privilege of bail by a Co-ordinate Bench of this Corot, vide judgment dated 17.12.2018 passed in Cr. Appeal (SJ) No.3817 of 2018 .

Having heard both sides and in view of the facts and circumstances, as stated above, let the appellant, above named, be enlarged on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned 1st Addl Sessions Judge cum Special Judge, West Champaran at Bettiah in2019 connection with Trial No.183 of 2017 arising out of Kangali P.S.Case No.10 of 2017, with condition that he will cooperate in disposal of the trial and will also appear as and when required by the learned court below; otherwise his bail bond shall be cancelled.
With the aforesaid direction, this application is allowed.
